Daughter alleges Harbourview Care caused mother's death

GALVESTON -- A Galveston County woman is suing a League City long-term care center, alleging negligence after her mother died while living at the defendant's facility.

Tammy Peoples, individually and as daughter of the deceased, Vivian Shippey, filed a lawsuit Sept. 16 in Galveston County District Court against Harbourview Care Center, Inc., League City, and Regent Management Services.

According to the complaint, Shippey was admitted to the long-term health care facility Aug 26, 2013. Because of poor care, under-staffing and negligence, the suit says, Shippey was injured in a fall Sept. 22, 2013, and died Sept. 29, 2013.

The plaintiff charges vicarious liability, negligence, gross negligence and violation of the Texas Penal Code by causing injury to an elderly individual.

Peoples says she has sustained funeral and burial expenses, loss of inheritance, loss of consortium and other damages. 

Peoples seeks punitive damages, attorney fees and court costs. She is represented by attorney Roy Camberg of The Camberg Law Firm PC in Houston.
