A woman is suing a Port Arthur motorist over injuries her son allegedly sustained as a result of a vehicle-pedestrian collision.
Susana Aguilar of Port Arthur, as mother, guardian, and next friend of minor Benjamin Aguilar, filed a lawsuit Sept. 30 in Jefferson County District Court against Anthony Mader, alleging negligence.
On Aug. 15, the complaint states, Mader was traveling westbound in the inside lane of state Highway 87, approaching Dallas Avenue in Port Arthur, and was behind a Port Arthur ISD school bus. The bus was stopped in the outside lane of Highway 87 in front of Dallas Avenue, and the bus driver had activated the bus' emergency lights and extended its stop sign, the suit says.
After the bus stopped, the lawsuit states,16-year-old Benjamin Aguilar was crossing SH-87 to board the bus, when Mader disregarded the bus' stop sign and flashing lights, and struck Aguilar as he was walking to the bus. The complaint alleges Mader was negligent in failing to stop behind a stopped school bus, failing to obey the bus' warning signals, failing to maintain lookout, failing to yield the right-of-way, speeding, failing to stop and render aid and fleeing the scene of the incident, among other negligent acts or omissions.
As a result, the suit says, Benjamin Aguilar sustained severe, critical, debilitating and life-threatening injuries, for which his mother has incurred medical expenses.
Susana Aguilar seeks damages within the jurisdictional requirements of this court, plus interests and court costs. She is represented by attorney Tommy L. Yeates of Moore Landrey in Beaumont.
