Woman sues Wal-Mart, alleging negligence for in-store accident

A Jefferson County woman is suing Wal-Mart, alleging negligence for injuries she says she sustained when she slipped and fell in a puddle inside a Port Arthur store.

Kimberly Franke filed a complaint Sept. 28 in Jefferson County District Court against Wal-Mart Stores Texas, alleging negligence.

On July 23, 2014, the complaint states, Franke was shopping in a Wal-Mart store, at 4999 N. Twin City Highway, Port Arthur, when she slipped and fell in a puddle of yellow-orange liquid, "possibly dish washing soap or liquid laundry detergent."

The lawsuit alleges the defendant was negligent in failing to maintain its premises in a reasonably safe condition, failing to inspect for dangerous conditions, failing to correct the dangerous condition and failing to inform of the dangerous condition, among other negligent acts or omissions.

As a result, the suit says the plaintiff sustained injuries to her neck, back, left knee, left ankle and left arm. She also sustained pain and suffering, mental anguish, impairment and disfigurement, loss of wages and earning capacity, and has incurred medical expenses, the complaint says.

Franke seeks monetary relief of less than $75,000, including attorney fees and court costs. She is represented by attorneys John A. Daspit and Robert Morse of Daspit Law Firm in Houston.
