Fuel supplier alleges Retzner Oil failed to fulfill contract

TEXARKANA -- A Texarkana company is suing an Indiana oil business, alleging breach of contract.

Truman Arnold Companies filed a lawsuit Oct. 6 in the Texarkana Division of the Eastern District of Texas against John E. Retzner Oil Company, of Batesville, Ind., and Adam Hanson, company president and chief executive officer.

According to the complaint, on July 21, 2014, Retzner Oild entered into a purchase agreement with Truman Arnold to purchase diesel fuel on a monthly basis for the year 2015 under contracts labeled "Atlanta" and "Memphis." The suit says the parties had an agreement for the defendant to pay the plaintiff if a specific number of gallons weren't purchased.

On Aug. 11, 2015, the suit says, Hanson said the July 2015 orders would be the last, leading to the breach of contract suit.

Truman Arnold Companies seeks $482,613.60 from the defendant for the contracted amount of fuel, plus interest and attorney fees. It is represented by attorneys Sean F. Rommel and James C. Wyly of Wyly-Rommel PLLC in Texarkana.
