Two employees accuse Barringer-Knoll, supervisor of unpaid overtime

Two Webster maintenance men are suing their employer and supervisor, alleging unpaid overtime.

David S. Hernandez and William L. Comstock filed a lawsuit July 28 in the Houston Division for the Southern District of Texas against Barringer-Knoll Community Association and S. John Wilkins III, alleging unpaid overtime wages in violation of the Fair Labor Standards Act.

According to the complaint while the plaintiffs have been employed by Barringer-Knoll as maintenance men, from Dec. 20, 2013 to the present, they worked more than 40 hours per week numerous times.

The complaint alleges the plaintiffs were not paid an overtime premium for time worked more than 40 hours per week.

Hernandez and Comstock seek to recover damages for unpaid overtime, liquidated damages, injunctive and declaratory relief, attorney fees and costs. They are represented by attorneys Charles L. Scalise and Daniel B. Ross of Ross Law Group in Austin.
