Trucker alleges Premier Tank Truck Service did not pay overtime

A Texas trucker is suing a trucking service, alleging unpaid overtime.

Robert Rainkin filed a lawsuit July 30 in the Houston Division of the Southern District of Texas against Texas Premier Resources, doing business as Premier Tank Truck Service, alleging unpaid overtime wages in violation of the Fair Labor Standards Act.

The complaint states that while he was employed by the defendant as an interstate truck driver, from July 1, 2014 to April 15, 2015, Rainkin only would receive a portion of overtime compensation owed to him.

The suit says Premier Tank Truck routinely would alter records and cause the plaintiff to under-report hours worked.

Rainkin seeks to recover overtime compensation, liquidated damages, attorney fees and costs. He is represented by attorney James M. Loren of Loren Law Group in Plantation, Fla.
