Family blames Loggins Logistics, truck driver for relative's death

The relatives of a deceased woman are suing an Arkansas logistics company and one of its truck drivers, alleging personal injury and wrongful death in a vehicle collision.

Gregory Messer, individually, as next friend of minor J. B., and as representative of the estate of his late wife Linda Messer, and Laci Jones, Lindsey Barnett, Johnny W. Nichols and Helen Nichols, filed a lawsuit July 29 in the Marshall Division of the Eastern District of Texas against Richard Caldwell of Arkansas and Loggins Logistics, alleging negligence.

On June 3, the complaint states, Linda Messer was driving her Lexus RX330 westbound on state Highway 77 in Cass County, when Caldwell, driving a commercial truck pulling a commercial trailer eastbound on Highway 77 in the scope of his employment with Loggins Logistics, crossed into the westbound traffic lane and struck Messer's vehicle.

At the time, J. B., Linda Messer's daughter, was a passenger in her vehicle, the suit says. J. B. and Messer sustained injuries in the collision, and Linda Messer died as a result of her injuries, the complaint states.

The suit alleges the defendants' actions constitute negligence.

The plaintiffs seek actual and exemplary damages, interests and court costs. They are represented by attorneys Michael E. Heygood and James Craig Orr Jr. of Heygood, Orr & Pearson in Dallas, and Bruce A. Flint and Matthew Q. Soyars of Flint & Soyars in Texarkana.
