Patient sues Texas OB/GYN, alleging medical negligence in death of unborn child

A Texas woman is suing her OB/GYN, alleging medical negligence after the loss of her unborn child.

Yessica Zapata filed a lawsuit Oct. 12 in Jefferson County District Court against Dr. Eduardo L. Jaramillo, alleging medical negligence.

The complaint states Jaramillo was Zapata's OB/GYN throughout her pregnancy.

On Aug. 1 and Aug. 8, 2013, Zapata complained to Jaramillo of spotting and decreased fetal movement but Jaramillo failed to take necessary action, according to the suit.

On Aug. 14, 2013, Jaramillo ordered an ultrasound for Zapata, which revealed intrauterine fetal demise, the lawsuit states.

The suit alleges Jaramillo was negligent in failing to adhere to the acceptable standard of care, failing to properly treat Zapata and her child within the standard of care, failing to timely identify and diagnose, failing to timely deliver and other negligent acts.

As a result, the plaintiff suffered loss of a child and has sustained physical impairment and disfigurement, pain and suffering, mental anguish and medical expenses.

Zapata seeks monetary relief between $200,000 and $1 million, plus costs of the suit. She is represented by attorney Michael S. Tilton of Tilton & Tilton in Houston.
