Collin County worker alleges city of Frisco fired him because of age

MARSHALL--A Collin County man is suing a municipality, alleging he was fired because of his age.

Benny Wilmeth filed a lawsuit Oct. 21 in the Sherman Division of the Eastern District of Texas against the city of Frisco, alleging age discrimination.

According the the complaint, Wilmeth had worked for the city in the Engineering Services Department for 12 years when he was discharged April 15. He was a crew leader in the department, and age 45, the suit says.

Wilmeth says he was terminated for "bullying behavior," which he denies. Furthermore, the suit alleges, co-workers constantly bantered back and forth, and one employee even stabbed a co-worker with a X-acto knife and he still works for the city.

The plaintiff says Frisco violated the Age Discrimination in Employment Act.

Wilmeth seeks a trial by jury, attorney fees, front and back pay, costs of court and all damages. He is represented by attorney Ronald R. Huff of Sherman.
