Dickinson woman sues convenience store, alleging negligence for fall

A Dickinson woman is suing a local convenience store, alleging negligence for injuries she says she sustained on the store premises.

Sherry Diogu filed a lawsuit June 26 in Galveston County District Court against Valero Energy Corporation, Valero Marketing and Supply Company, Izzy Properties, Muhammad Anwar, individually, and Muhammad Anwar, doing business as KC's Stop N Shop, alleging negligence.

On Sept. 16, 2013, the suit states, Diogu was entering KC's Stop N Shop at 2221 Pine Drive, Dickinson, when she tripped and fell on broken concrete. The suit says the defendants were negligent in failing to maintain the property in a safe and reasonable manner, failing to exercise caution and provide warning, and other negligent acts or omissions.

As a result, the suit says the plaintiff sustained personal injuries, physical pain and suffering, mental anguish and medical expenses.

Diogu seeks monetary relief between $200,000 and $1 million, plus court costs. She is represented by attorney Joshua Leske of Young & Husain in Houston.
