Galveston woman sues Comfort Inn, Hampton Inn, alleging unpaid overtime

A Galveston woman is suing the Comfort Inn and Hampton Inn hotel chains, alleging unpaid overtime.

Amairani Pacheco, as an individual and for others similarly situated, filed a collective action lawsuit Nov. 3 in the Galveston Division of the Southern District of Texas against Neel Shah Hospitality, doing business as Comfort Inn & Suites, Isha Realty, doing business as Hampton Inn & Suites, and Suresh Shah, alleging unpaid overtime wages in violation of the Fair Labor Standards Act.

Pacheco is employed by the defendants in food service and housekeeping for their hotels in Galveston, the suit says, and she usually works 5 a.m. to 7 p.m., five to seven days a week, for which she is paid an hourly rate.

The suit alleges the defendants do not pay Pacheco or others similarly situated employees an overtime premium for time worked more than 40 hours per week.

Pacheco and others in the class seek to recover unpaid overtime wages, liquidated damages, costs of the suit and attorney fees. Pacheco is represented by attorneys Mark Siurek and (of counsel) Patricia Haylon of Warren & Siurek in Houston.
