Insurance firm alleges non-payment of surety bonds

HOUSTON -- An insurance company is suing an Austin company and two of its agents, alleging failure to pay a performance bond and a payment bond.

RLI Insurance Company filed a lawsuit Nov. 3 in the Houston Division of the Southern District of Texas against Omega Fire Systems of Austin, and Benjamin and Katherine Griffin of Leander, both registered agents for Omega.

According to the complaint, on Sept. 6, 2013, RLI Insurance entered into an agreement of indemnity with the defendants. Shortly afterward, the plaintiff executed a performance bond and a material payment bond for the construction of the University of Houston football stadium and for a sprinkler system.

On both projects, the suit says, the plaintiff received a notice of non-payment by Omega. The plaintiff alleges it has lost $713,757 under both bonds, and is suing to get that money back.

RLI Insurance seeks a trial by jury, damages, attorney fees, interest and court costs. It is represented by attorneys Greg K. Winslett and Michael D. Feiler of Quilling, Selander, Lownds, Winslett & Moser, in Dallas.
