Ambulance driver alleges Infinity EMS failed to pay overtime

A former employee is suing an emergency medical services company, alleging unpaid overtime.

Recartor Patterson filed a lawsuit Nov. 12 in the Houston Division of the Southern District of Texas against Infinity EMS and James R. Chaney, alleging unpaid overtime wages in violation of the Fair Labor Standards Act.

According to the complaint, while Patterson worked for the defendants as a first responder/ambulance driver, from August 2013 to August 2015, he worked more than 40 hours for one or more work weeks and was paid on an independent contractor basis, although he was legally an employee of the company.

The suit alleges the defendants did not pay the plaintiff an overtime premium for time worked more than 40 hours per week.

Patterson seeks to recover unpaid wages, liquidated damages, interests, attorney fees and costs. He is represented by attorney Kerry V. O'Brien of O'Brien Law Firm in Austin.
