Tenant blames Crystal Creek Park, ITEX Property Management for bedroom injuries

A Jefferson County woman is suing the owners of a Port Arthur apartment complex, alleging negligence for injuries she says she sustained in an accident in her bedroom.

Malecka Randall filed a lawsuit Nov. 13 in Jefferson County District Court against Crystal Creek Park and ITEX Property Management, alleging negligence, gross negligence and premises liability.

Randall lived in an apartment at the Crystal Creek Park Apartment complex, owned by the defendants, in Port Arthur. On April 15, the suit states, Randall was walking in her bedroom when she slipped and fell on a puddle of water that was leaking up through the floor of the room. Randall attempted to grab a nearby dresser to break her fall but the dresser tipped over and fell on her, the complaint states.

The suit alleges the defendants were negligent in failing to remedy a dangerous defect on the premises, failing to maintain the premises in a reasonably safe condition, failing to inspect and correct where the dangerous condition existed and other negligent acts or omissions. 

As a result, the suit alleges the plaintiff sustained injuries to her head, neck, and other body parts. She has also sustained pain and suffering, mental anguish, impairment and disfigurement, loss of enjoyment of life, and medical expenses, the suit states.

Randall seeks monetary relief of more than $1 million, including interests and court costs. She is represented by attorney Sofia E. Bruera of Pierce Skrabanek Bruera in Houston.
