Federal complaint accuses Honda of patent infringement

Plano-based Rothschild Connected Devices Innovations, LLC asserts in a federal lawsuit that American Honda Motor Co., Inc. and Honda Of America Mfg., Inc. committed infringement on a patent pertaining to systems and components that allow a user to remotely customize the operation of various functions in a car.

Court papers filed Nov. Nov. 25 in the Eastern District of Texas, Marshall Division state that RCDI owns United States Patent Number 8,788,090, which is titled “System and Method for Creating Personalized Consumer Product.”

According to the suit, the defendants “have infringed and continue to infringe one or more claims, including at least claim 1, of the ‘090 patent by making, using, importing, selling, and/or offering for sale a customizable system to remotely control available automobile functions covered by one or more claims” in the subject patent.

The ‘090 patent further allows the user to set preferences through the use of an app which may reside on a smartphone, the suit adds, and a remote server receives the identity of the vehicle and the identity of a user, retrieves the user’s preferences, and transmits those preferences to a communication module within the vehicle

“The defendants sell, offer to sell, and/or use systems, including, without limitation, the HondaLink EV system and HondaLink EV app, and related connectable components, which may operate in connection with these systems, which infringe at least Claim 1 of the ‘090 Patent,” the original petition says.

Consequently, RCDI seeks unspecified monetary damages and a jury trial.
