Texarkana woman accuses Encore Receivable of phone harassment

TEXARKANA— A Texarkana woman is suing a debt collection agency, alleging she was harassed in violation of federal law.

Kathie Barber filed a lawsuit Jan. 11 in Texarkana County District Court against Convergys Corporation, doing business as Encore Receivable Management Inc., alleging violation of the Telephone Consumer Protection Act.

According to the complaint, Barber began to notice Encore was calling her regularly and often on multiple phone numbers, including her personal cell phone, in order to collect alleged debts on the plaintiff's credit card. Over a period of time, the defendant made 295 calls to the plaintiff, the suit says. 

Although the lawsuit states the defendant was asked to stop calling, the calls continued, in direct violation of legislation requiring express consent. 

Barber seeks $100,000 pursuant to the Fair Debt Collection Practices Act, as well as compensation for legal fees. She is represented by attorney Jeffrey E. Lohman of Corona, California.
