Hardin County man blames apartment owners for fall through attic floor

BEAUMONT — A Hardin County man is suing the owners of a Silsbee apartment complex, alleging negligence after he says he fell through an attic floor.

Sylester McLaurin filed a lawsuit Jan. 8 in the Jefferson County District Court against Land Vault Holdings LLC, doing business as Prince Hall Apartments, Shane Warr, Kenneth Smith and Ace Rental Management LLC, alleging negligence.

According to the complaint, on May 1, 2014, McLaurin was working in the attic space of the aforementioned apartment complex, which is owned and leased by the defendants. While working in the attic, the suit says, he fell through the floor and was caused extensive personal physical injuries. 

Although the defendants were the owner of the property, they are non-subscribers to the Texas Workers' Compensation, the lawsuit states, and their failure to warn the plaintiff of the situation was wrongful, as they owed McLaurin a reasonably safe workplace. 

McLaurin seeks a jury trial, damages for physical pain, mental anguish, physical impairment, medical expenses, loss of wages and capacity to earn wages, as well as court costs. He is represented by attorney Jason L. Cansler of The Law Offices of Jason L. Cansler in Beaumont.
