Harris County man alleges Overhead Door negligence caused job-site accident

GALVESTON — A Harris County man is suing a Houston door company, alleging injuries he says he sustained on the job.

Jason Schmoloke filed a lawsuit Jan. 4 in Galveston County District Court against Commercial Door Company of Houston, doing business as a Overhead Door Company of Houston, alleging negligence and gross negligence.

On Oct. 10, 2014, the complaint states, Schmoloke was working for WC Tier One Personnel, an independent contractor to Overhead Door, at the defendant's premises near Interstate Highway 45 and state Highway 6 in Santa Fe. Schmoloke was loading the defendants' trucks with overheard door materials, the suit says, when he stepped into a hole in the wooden floor of a trailer and fell through, causing his hand to be crushed between a roll-up door and the floor.

The suit alleges the defendant was negligent in failing to warn of an unreasonably dangerous risk, among other negligent acts or omissions.

Schmoloke seeks monetary relief between $200,000 and $1 million, interests and court costs. He is represented by attorney Andrew E. Lemanski of Andrew E. Lemanski & Associates in Houston.
