Nacogdoches County man alleges Refinery Specialties did not pay overtime

HOUSTON - A Nacogdoches County man is suing a Texas oilfield services company and its president, alleging they did not pay him overtime wages.

Cody Jarrett filed a lawsuit Jan. 25 in U.S. District Court for the Southern District of Texas Houston Division against Refinery Specialties Inc. and Mickey D. Tucker, alleging violations of the Fair Labor Standards Act.

The suit states that while Jarrett was employed by the defendants as a salaried supervisor, he regularly worked more than 40 hours per week. The lawsuit states the defendants misclassified Jarrett as exempt from receiving overtime, but he should have been classified as a non-exempt employee and be eligible to receive overtime wages.

Jarrett seeks declaratory judgment, monetary damages, liquidated damages, interests, attorney fees and other costs. He is represented by attorney Josh Sanford of Sanford Law Firm PLLC in Little Rock, Arkansas.
