HOUSTON — A project supervisor is suing a Houston company, alleging violations to the Fair Labor Standards Act concerning unpaid overtime work.
James Spangler filed a lawsuit on Feb. 9 in the Houston Division of the Southern District of Texas against Mourik LP, a Houston business that has employees who engage in commerce.
According to the complaint, Spangler, a field service contractor, worked for Mourik from January 2013 to November 2015 and was classified as an exempt employee, although he had no ability to hire or fire employees or input into employment or compensation decisions. Spangler says he worked more than 40 hours a week and was not paid extra for the overtime hours.
In November 2015, the suit says, Mourik terminated Spangler, and Spangler entered into a severance agreement which the plaintiff would not release claims against Mourik.
Spangler seeks a jury trial, back pay equal to the amount of unpaid overtime from past pay periods, reasonable attorney fees and court costs. He is represented by attorney David C. Holmes in Houston.
