GALVESTON — A tenant is suing a Kemah apartment complex, alleging an illegal attempt to collect money.
Terri Elizabeth Taylor, of Dickinson, filed a lawsuit Jan. 27 in Galveston County District Court against Summerbroke Property Owner LC, doing business as Summerbroke Apartments in Kemah and IQ Data International Inc., alleging violation of the Fair Debt Collection Act, fraud and negligent misrepresentation.
According to the complaint, Taylor was a tenant in the Summerbroke Apartments from October 2013 until Nov. 3, 2014. The plaintiff states she paid all bills and requests made by the defendant and never violated her lease.
The lawsuit states Summerbroke harassed, intimidated and wrongfully tried to collect funds from Taylor, and did so by employing IQ Data International Inc., which reported the plaintiff's credit report. The plaintiff has disputed the actions of the defendants but she has been damaged by harassment and collection practices, the suit states.
Taylor seeks damages for court costs, pre and post-judgment interest, attorney fees and actual damages. She is represented by attorneys John V. Mastriani and Christopher M. Thornhill of The Mastriani Law Firm in Houston.
