Harris County couple sues brokers, realty companies over alleged issues with property

GALVESTON – A Harris County couple is suing several title and realty companies over claims they omitted a part of the property description of the property purchased by the couple.

Gordon R. Little Jr. and Lisa Capece-Little filed a complaint on Feb. 11 in the Galveston County District Court against Matthew D. Wiggins Jr., Keller Williams Realty Inc. Realtors, Keller Williams Clear Lake/NASA, Alana Croker, First American Title Insurance Co., First American Title Insurance Co. in Texas, First American Title Co. LLC, First American Title Co. and First American Title Co. - Houston Division, citing breach of contract and other counts.

According to the complaint, the plaintiffs allege that on April 14, 2014, they purchased a property at 2538 Cliff Drive, San Leon from Wiggins Jr. The suit states they later decided to sell it that November, but discovered that the conveyance was improperly prepared and that the defendants misrepresented it as a water-front property. They allege this has resulted in a loss of value of the property.

The plaintiffs seek the following: compensation for relief of not more than $1,000,000 but more than $200,000, all other relief attorneys' fees and interest. They are represented by Kimberly R. Rankin and Bennett G. Fisher of Fisher & Associates in Houston.
