Insurance policyholder sues Allstate Texas alleging breach of contract

GALVESTON — A Friendswood woman is suing her insurance company and its adjuster after her property was allegedly damaged in a storm and they failed to pay her for all damages covered by her policy.

Kelly Niestzche filed a complaint on Feb. 29 in Galveston District Court against Allstate Texas Lloyds and Christopher Casada, citing alleged breach of contract.

According to the complaint, the plaintiff alleges that her property suffered damages caused by a storm on Oct. 13, 2014. She alleges that Casada performed a substandard inspection of the property, failed to include all damages in his report to the insurance company and undervalued the cost to repair the property damage. 

Niestzche seeks compensation for all damages, plus attorneys fees and costs of the suit. She is represented by Ana M. Ene of Daly & Black, P.C. in Houston.
