Client alleges attorney failed to represent him properly

GALVESTON — A Texas man is suing his attorney, alleging legal negligence.

Colin Henry filed a lawsuit March 2 in Galveston County District Court against Elaine S. Mitchell, alleging the lawyer failed to represent him properly in several disputes in the Galveston County courts.

According to the complaint, Henry lost several disputes and thousands of dollars in fees and costs, and he holds Mitchell responsible. The suit says the defendant negligently allowed all of Henry's lawsuits to be lost, failed to file several of his claims, fraudulently concealed what took place on the claims she handled, did not inform him at any time of the implications in any of the cases she represents and owed him the legal duty to represent him in matters he had entrusted her.

Henry seeks compensation for actual, punitive and exemplary damages, attorney fees that Mitchell has collected as the result of acting as his counsel, pre-judgment and post-judgment interest, plus attorney fees and costs as allowable by law. He is represented by attorney Donald T. Cheatham of Cheatham Law in Houston in Texas.
