Client accuses Hartford Insurance of contract breach

GALVESTON — A Galveston man is suing Hartford Insurance, alleging it wrongfully denied to pay for loss of property. 

Johnnie Emery Maxey Sr. filed a lawsuit Feb. 17, in Galveston County District Court against Hartford Insurance Company of the Midwest,  alleging breach of contract and break of implied warranty. 

According to the complaint, on July 3, 2015, Maxey he was involved in a vehicular accident and while he was taken to the hospital, his Cadillac was towed. The suit says the plaintiff was informed by an employee of Hartford that the vehicle was a total loss and the insurance company would process the claim. 

After months of waiting for the claim, the lawsuit states, the plaintiff was then informed that his vehicle would be repaired instead.. 

The suit states the defendant misinformed the plaintiff that his property was a total loss and that Hartford Insurance failed to properly and adequately compensate the plaintiff, in violation of the Texas insurance code, 

Maxey seeks compensation for all damages including interest, legal fees, a jury trial and any other relief as this court deems just and proper. He is represented by attorney Douglas T. Godinich of Galveston.
