Two workers accuse energy companies of FLSA violations

HOUSTON — Two employees are suing two energy companies, alleging failure to pay overtime.

James Smith and David Dukate, individually and on behalf of all others similarly situated, filed a class action lawsuit March 18 in the Houston Division of the Southern District of Texas against KLX Energy Services LLC of Houston and Blue Dot Energy Services LLC of Charleston, West Virginia, alleging the defendants knowingly violated the Fair Labor Standards Act by failing to pay overtime wages to employees.

According to the complaint, Smith and Dukate worked more than 40 hours per work week but was not paid any overtime wages. The suit says the defendants misclassified their employees to exempt them from overtime pay.

Smith and Dukate seek compensation for all damages, unpaid wages plus interest in the maximum rate of the law, all legal fees, a jury trial and any other relief the court deems proper. They are represented by attroneys Michael A. Josephson, Andrew Dunlap, Lindsay R. Itkin and Jessica M. Bresler of Fibich, Leebron, Copeland, Briggs & Josephson in Houston, and Richard J.
