Customer alleges GM negligence led to car accident

MARSHALL — A customer is suing a GMC dealership, alleging its negligence led to an accident.

Constance Rios filed a lawsuit March 10 in the Marshall Division of the Eastern District of Texas against Cummins Chevrolet Buick GMC Cadillac Inc. and Cummins employee John Michael Austin, alleging their negligence resulting in injuries.

According to the complaint, on March 13, 2014, Rios was in a vehicular accident which caused injuries to him and damages to his vehicle. The suit says Cummins and Austin are responsible because Austin failed to stop at a red light and then crashed into the plaintiff. At the time of the accident, Austin was working for Cummins, the suit says.

Rios seeks compensation for all damages, interest allowed by the law, all legal fees and any other relief as this court deems just and proper, plus a jury trial. He is represented by attorneys Brent Goudarzi and Marty Young of Goudarzi & Young LLP in Gilmer.
