HOUSTON – A warehouse worker is suing his former employers alleging that they failed to properly compensate their employees by paying overtime wages.
Melvin Gonzalez filed a class-action complaint on behalf of all similarly situated persons on March 10 in the Houston Division of the Southern District of Texas against All Harvest Trading LLC and Henry L. Chea citing violation of the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that between 2012 and June 2015, he was paid less than minimum wage and did not receive any overtime pay for all hours worked over 40. The plaintiff holds All Harvest Trading LLC and Chea responsible because the defendant allegedly knew that their employees were working more than 40 hours per work week but failed to pay them their overtime wages.
The plaintiff seeks the following: compensation for trial by jury, all damages, payment for all unpaid minimum and overtime wages, interest, all legal fees and any other relief as this court deems just. He is represented by Josef F. Buenker and Vijay A. Pattisapu in Houston.
