Worker alleges Texas company violated overtime laws

HOUSTON — An employee is suing a Texas company, alleging unpaid wages and violation of workers compensation acts.

Antonio Pineda filed a class action lawsuit, individually and on behalf of all others similarly situated, April 7 in the Houston Division of the Southern District of Texas against Scandrill Inc. alleging failure to use the correct rate for employee overtime wage and bonuses.

According to the complaint, Pineda and fellow workers did not receive their overtime wage required by the Fair Labor Standards Act. The plaintiff alleges Scandrill failed to follow the rate according to the FLSA when calculating for overtime wages for employees.

Pineda seeks a trial by jury, all unpaid overtime compensation, plus liquidated damages equal to the unpaid wages, interest at the highest rate allowed by the law, legal fees and any other relief the court deems just. He is represented by attorneys Michael A. Josephson, Lindsay R. Itkin, Andrew W. Dunlap and Jessica M. Bresler of Fibich, Leebron, Copeland, Briggs & Josephson in Houston and Richard J.
