BEAUMONT — A Tyler County couple is suing a Nederland motorist, alleging his negligence caused a crash.
James Rust and Mandy Rust filed a lawsuit April 4 in Jefferson County District Court against Francisco Javier Monroy alleging his failure to to apply his brakes caused his vehicle to hit plaintiffs' truck.
According to the complaint, on June 24, 2014, the Rusts sustained injuries and damages to their truck and trailer when they were struck from behind as they traveled northbound on the 2200 block of Interstate Highway 10. The plaintiffs allege Monroy failed to control his vehicle and apply his brakes, causing him to strike the plaintiffs' vehicle.
The plaintiffs allege they have sustained medical expenses and loss of earnings.
The plaintiffs seek more than $100,000, all damages plus interest, all legal fees and any other relief the court deems just. They are represented by attorneys Lindsey B. Whisenhant, Brad Elrod and Lucas Babin of the Law Office Of Lindsey B. Whisenhant in Woodville.
