Motorist accuses insurance firm of breach of contract

MARSHALL — A Galveston County motorist is suing an insurance company, alleging breach of contract.

Duane Shelton filed a lawsuit March 24 in the Marshall Division of the Eastern District of Texas against Bitco General Insurance Corporation & General Insurance Company of America, alleging it failed to pay the plaintiff's benefits after he was injured in a car crash.

According to the complaint, on Feb. 5, 2013, Shelton suffered injuries and car damage when he was struck by another vehicle driven by Sarah Joyce Lappin in Franklin County. The plaintiff alleges Bitco failed to pay full benefits for injuries he sustained in the accident.

Shelton requests a trial by jury, judgment against the defendant, plus interest, all legal fees and any other relief the court deems just. He is represented by attorneys Craig M. Daugherty and Kristina Ross of Beard & Harris in Tyler.
