Evanston Insurance Co. files suit against Mid-Continent Casualty Co.

HOUSTON – An insurance company is seeking reimbursement from another insurance company after a Houston accident.

Evanston Insurance Co. filed a complaint on March 28 in the Houston Division of the Southern District of Texas against Mid-Continent Casualty Co., seeking reimbursement.

According to the complaint, on Nov. 15, 2013, an accident on Beltway 8 in Houston killed the insured's driver and a woman and severally injured another woman. Lawsuits were filed by the women's families, the suit states, and after paying $1 million, Mid-Continent claimed its policy was exhausted. The suit states Evanston paid more than $5 million. The plaintiff holds Mid-Continent Casualty Co. responsible because the defendant allegedly failed to pay all defense costs and indemnity proceeds after filing for benefit claims for their insured employee.

The plaintiff seeks actual damages in the amount proven in trial, interest at the highest rate allowed by the law, all legal fees and any other relief as this court deems just. It is represented by Stephen P. Pate, Jason K. Fagelman and James Brunsting Hartle of Norton Rose Fulbright US LLP in Houston.
