Employees allege food business failed to pay overtime

HOUSTON — A group of employees is suing a food business, alleging unpaid wages.

Raul Zapata, Hugo Galdamez, Xavier Gutierrez, Armando Cuevas, Candelario Lopez, Gilberto Lopez, Julio Corona-Guzman, John Fontenot, Steve Ellis, Jerry Thomas and Pablo Ruiz Rubio filed a lawsuit individually and on behalf of all others similarly situated March 14 in the Houston Division of the Southern District of Texas against Flowers Foods Inc. and Flowers Baking Co. of Houston LLC, alleging failure to compensate employees by paying overtime wage.

According to the complaint, the plaintiffs allege they worked for more than 40 hours per week but did not receive any overtime pay. The plaintiffs allege the defendants failed to pay overtime wages despite having knowledge of the total hours their employees worked.

The plaintiffs seek a trial by jury, all unpaid overtime wage, liquidated damage equal to the unpaid wage, interest at the highest rate allowed by the law, all legal fees and any other relief the court deems just. They are represented by attorneys Alfonso Kennard, Jr. and Arnoldo J. Rodriguez of Kennard Richard PC in Houston.
