XPO Logistics accused of damaging cargo in transport

HOUSTON – A Michigan corporation is suing a carrier alleging that it damaged cargo in transportation from South Carolina to Missouri.

Perrigo Corp. filed a complaint on March 18 in the Houston Division of the Southern District of Texas against XPO Logistics Freight Inc., formerly known as Con-Way Freight Inc., citing breach of contract and breach of duty.

According to the complaint, the plaintiff alleges that in February 2014, it suffered damages to its business as a result of its cargo of pharmaceutical products being damaged while being transported by the defendant. The plaintiff holds XPO Logistics Freight Inc. responsible because the defendant allegedly failed to deliver the cargo in perfect condition and as a result, it was sent back to the plaintiff to be destroyed as required by the law.

The plaintiff requests a trial by jury and seeks the sum of $287,070.68 for the damaged cargo plus cost and interest, and any other relief as this court deems just. It is represented by Ryan J. Vechan of Hill Rivkins LLP in Houston.
