Motorist alleges GM design defect caused injuries in car crash

SHERMAN — A Honey Grove motorist is suing General Motors, alleging a design defect caused him to suffer injuries in a car crash.

Rush Lee Smith of Honey Grove filed a lawsuit April 19 in the Sherman Division of the Eastern District of Texas against General Motors LLC, alleging design defect, negligence and product liability.

According to the complaint, on Jan. 22, Smith suffered injuries despite wearing safety restraints when his vehicle struck another on state Highway 121 in Trenton. The plaintiff alleges GM manufactures vehicles that are not crash-worthy and may cause injuries.

The suit says the plaintiff has sustained pain and suffering, impairment and reduced ability to enjoy life.

Smith seeks actual damages, interest, all legal fees and all other relief the court deems just. He is represented by attorneys E. Todd Tracy, Stewart D. Matthews and Andrew G. Counts of The Tracy Firm in Dallas, and by Todd Clement of The Clement Firm, also in Dallas.
