GALVESTON — A Houston couple is suing a Kemah property owner, alleging failure to fulfill contract obligations.
Phil A. Erickson, Jr. and Tammy Sherryl Erickson of Houston filed a lawsuit April 21 in Galveston County District Court against Joseph Pat Cunningham of Kemah, alleging breach of contract.
According to the complaint, between Nov. 20, 2008, and May 9, 2015, the Ericksons suffered damages as a result of their contract with the property owner not being fulfilled. The plaintiffs allege Cunningham failed to timely correct the error found on the title to a Houston property they had purchased for $51,983.85, and despite the error being corrected, the defendant has still refused to fulfill his financial obligation under the contract by turning over the property.
The Ericksons seek damages of up to $100,000, plus interest, all legal fees and any other relief the court deems just. They are represented by attorneys Christopher B. Heald and Cameron Wells of Silberman Law Firm PLLC in Houston.
