Class action filed against Applus Velosi America over unpaid overtime claims

GALVESTON – A welding and electrical inspector alleges his employer did not pay him overtime wages and has filed a class-action suit.

David Erwin filed a complaint on behalf of all others similarly situated on April 21 in the Galveston Division of the Southern District of Texas against Applus Velosi America LLC alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he worked for more than 40 hours per work week but did not receive any overtime compensation. The plaintiff holds Applus Velosi America LLC responsible because the defendant allegedly misclassified its employees in order to avoid paying them overtime compensation.

The plaintiff requests a trial by jury and seeks overtime compensation for all hours worked, liquidated damages equal to the unpaid overtime wages, all legal fees and any other relief as this court deems just. He is represented by Galvin B. Kennedy of Kennedy Hodges LLP in Houston.
