Starr County worker accuses energy company of overtime violations

HOUSTON — A Starr County man is suing an energy company, alleging failure to pay overtime wages.

Efren Alanis of Starr County, individually and on behalf of all others similarly situated, filed a lawsuit April 22, in the Houston Division of the Southern District of Texas against ECR Energy Source Inspection Services LLC, and Denise Swartz, alleging violation of the Fair Labor Standards Act in failing to fairly compensate employees.

According to the complaint, in 2014 Alanis worked as a pressure vessel inspector for more than 40 hours per week but was not paid any overtime. The plaintiff alleges the defendants failed to maintain an accurate pay record for their employees and paid them a normal hourly rate instead of the time and a half hourly rate for overtime.

Alanis seeks a trial by jury, all unpaid wages, liquidated damages, interest, incentive awards, all legal fees and any other relief the court deems just. He is represented by attorneys Melissa Moore, Rochelle Owens and Curt Hesse of Moore & Associates in Houston.
