Worker alleges home appliance repair business failed to pay overtime

HOUSTON — A Harris County man is suing a Texas home appliance repair business, alleging failure to pay overtime to its employees. 

Richard Chambers filed a class action lawsuit, individually and on behalf of all others similarly situated, April 28 in the Houston Division of the Southern District of Texas against D3S Service LLC and Scott Klintworth, alleging they violated the Fair Labor Standards Act in failing to fairly compensate employees.

According to the complaint, between March 2015 and March 2016, Chambers worked more than 40 hours every week but was not paid an overtime wage at the proper rate. The plaintiff alleges the defendants had knowledge of the total hours their employees were working but chose to pay them at a daily rate instead of the proper rate as defined by FLSA.

Chambers seeks a trial by jury, all overtime compensation, liquidated damages, interest, all legal fees and any other relief the court deems just. He is represented by attorneys Melissa Moore, Rochelle Owens and Curt Hesse of Moore & Associates in Houston.
