Employee accuses Houston food business of failing to pay overtime

HOUSTON — An employee is suing a Houston food business, alleging failure to pay overtime to employees.

Kara Spears of Houston filed a lawsuit April 27 in the Houston Division of the Southern District of Texas against Martin Preferred Foods LP, alleging violation of the Fair Labor Standards Act in failing to fairly compensate employees.

According to the complaint, between 2003 and March 7, 2016, Spears worked for more than 40 hours per week for Martin as an office manager, including one week when she worked 55 hours, but was not paid overtime wages. The plaintiff alleges Martin violated FLSA in not paying her time and a half for time worked more than 40 hours a week.

Spears seeks a trial by jury, unpaid overtime wages owed, liquidated damages equal to the unpaid overtime, interest, all legal fees and any other relief the court deems just. She is represented by attorney Charles L. Scalise of Ross Law Group in Austin.
