BEAUMONT — A motorist is suing Honda, alleging its vehicles fail to protect drivers during a crash.
Mason Bynes filed a lawsuit April 27 in the Beaumont Division of the Eastern District of Texas against American Honda Motor Co. Inc. and Honda Motor Company, Ltd., alleging breach of implied warranty, breach of warranty, design defect, and product liability in the manufacturing of vehicles that are not crashworthy.
According to the complaint, on Dec. 14, 2015, Byrnes sustained personal injuries when the safety features of her car, a 2004 Honda Civic, failed to protect her after it flipped on its roof in a crash. The plaintiff alleges Honda manufactured and distributed vehicles that are defective and not crashworthy.
The suit says the plaintiff has sustained pain and suffering, extreme emotional distress, mental anguish, impairment, disfigurement and a reduced capacity to enjoy life.
Byrnes seeks actual damages, economic and non-economic damages, interest, all legal fees and any other relief the court deems just. She is represented by attorneys E. Todd Tracy, Stewart D. Matthews and Andrew G. Counts of The Tracy Firm in Dallas.
