Insurance firm alleges client breached policy

Insurance 03

HOUSTON — An insurance firm is suing a Katy woman, alleging breach of contract and liability.

RLI Insurance Company filed lawsuit April 7 in the Houston Division of the Southern District of Texas against Marie Costello alleging she wrongfully filed a case against the plaintiff regarding the coverage of her insurance.

According to the complaint, between Feb. 19-April 7, 2016, RLI Insurance was damaged as a result its policy being breached. The plaintiff alleges Costello filed a suit against RLI, stating it should cover all the damages done to her vehicle in a collision Oct. 30, 2015, despite the policy stating the damages covered only specific areas.

RLI Insurance asks the court to declare there is no coverage under the policy for certain damages done to the vehicle, that the plaintiff does not owe the defendant any additional sums, plus any additional relief the court deems just. It is represented by attorneys Greg K. Winslett and Michael D. Feiler of Quilling, Selander, Lownds, Winslett & Moser PC in Dallas.
