2 employees allege Bank of America failed to pay overtime

Late 06

HOUSTON — Two employees are suing Bank of America, alleging failure to pay overtime wages.

John Cosgrove and Richard Taylor filed a lawsuit May 6 in Houston Division of the Southern District of Texas against Bank of America Corp. Landsafe Inc. and Landsafe Appraisal Services Inc., alleging violation of the Fair Labor Standards act in failing to fairly compensate employees.

According to the complaint, Cosgrove and Taylor worked for more than 40 hours a week as staff appraisers but were not paid any overtime compensation. The plaintiffs allege the defendants failed to provide adequate overtime compensation to their employees according to the total hours the employees worked in a given week.

Cosgrove and Taylor seek all unpaid overtime compensation, liquidated damages, interest, all legal fees and any other relief the court deems just. They are represented by attorneys Andrew M. Edison and Nicholas R. Lawson of Edison, McDowell & Hetherington LLP in Houston.
