Husband blames Wal-Mart for wife's hard fall

GALVESTON — A husband is suing Wal-Mart, alleging its negligence caused his late wife to suffer a violent fall, 

Eugene Essary, as representative of the estate of Minda Faye Essary, filed a lawsuit May 17 in the Galveston Division of the Southern District of Texas against Wal-Mart Stores Texas LLC, alleging negligence in failing to keep its premises clean and safe.

According to the complaint, on April 1, 2015, Minday Faye Essary fell violently at the Wal-Mart, 9235 Sam Houston Parkway, Houston, due to improperly stacked weather mats. The suit says Essary suffered injuries to her right hip, requiring surgery. 

The plaintiff alleges Wal-Mart failed to maintain a safe facility free from any hazard that could cause an accident.

Essary seeks a trial by jury, all damages, medical expenses, interest, legal fees and any other relief the court deems just. He is represented by attorney Dax F. Garza of Houston.
