Staffing agency, energy company accused of misclassifying employees

HOUSTON – A flowback operator alleges he was not paid overtime ages and has filed a class-action lawsuit.

Dustin Adams filed a complaint on behalf of others similarly situated on June 3, in the Houston Division of the Southern District of Texas against David Boone Oilfield Consulting & EP Energy Corp. alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that since May 2014, he has worked for more than 40 hours per workweek without receiving any overtime compensation. The plaintiff holds David Boone Oilfield Consulting & EP Energy Corp. responsible because the defendants allegedly failed to pay overtime wages to plaintiff in violation of the FLSA and misclassified them as independent contractors.

The plaintiff requests a trial by jury and seeks all unpaid overtime compensation, liquidated damages, all legal fees, interest at the highest rate allowed by the law, and any other relief as this court deems just.
