Man alleges Allstate hasn't paid benefits

MARSHALL – A Rusk County man alleges an insurance company has failed to pay him after an accident.

Alfred Ray Spencer Jr. filed a complaint on June 8 in the Marshall Division of the Eastern District of Texas against Allstate Insurance Co. seeking declaratory relief.

According to the complaint, the plaintiff alleges that on July 22, 2012, he was involved in a vehicular accident for which he sustained physical injuries and damages to his property. The plaintiff holds Allstate Insurance Co. responsible because the defendant allegedly failed and refused to pay benefits to plaintiff as the insurance provider of the driver that struck the plaintiff.

The plaintiff requests a trial by jury and seeks all damages, statutory penalty, interest, 18 percent per annum as additional damages, all legal fees and any other relief as the court deems just. He is represented by J.R. "Rusty" Phenix and Cary Crump of Phenix & Crump PLLC in Henderson.
