Customer alleges restaurant's negligence caused her injuries

GALVESTON — A customer is suing a Galveston County restaurant, alleging its negligence caused her to fall and suffer injuries.

Kimberly Caldwell filed a lawsuit June 22 in Galveston County District Court against Rakinder Syal and Harsh Veer, individually and doing business as The Fish Place, and Rakinder Syal & Sons Inc., alleging negligence in failing to train its employees on the proper and safe procedures to keep the premises safe and clean.

According to the complaint, on Jan. 23, 2015, while Caldwell was entering the dining room of The Fish Place in League City, she slipped and fell on substances that were left on the floor, causing her to sustain significant personal injuries, plus medical expenses. 

The plaintiff alleges the defendants failed to ensure and enforce proper safety rules and regulations, failed to properly maintain the floors and public walkways free from materials and substances, failed to implement safe operating procedures and failed to warn Caldwell of the dangerous condition.

Caldwell seeks a trial by jury, more than $100,000 in damages, legal costs, interest, pre-judgment and post-judgment interest, and such other relief to which she is justly entitled. She is represented by attorney Sherry Scott Chandler of The Chandler Law Firm LLP in Houston.
