Flowback operator alleges energy business failed to pay overtime

HOUSTON — A flowback operator is suing an energy company, alleging failure to pay overtime wages.

Andrew Pamintuan filed a lawsuit June 24 in the Houston Division of the Southern District of Texas against Production Testing Service, Inc. alleging failure to to comply with the provisions of the Fair Labor Standards Act.

According to the complaint, between April 2015 and February 2016, Pamintuan regularly worked more than 40 hours each week but never received overtime pay. The plaintiff alleges because the defendant classified him as an independent contractor, Production Testing failed to pay Pamintuan the overtime premium for all hours worked in excess of 40 hours a week in accordance with the FLSA.

Pamintuan seeks a trial by jury, unpaid back wages, attorney fees, legal costs, pre- and post-judgment interest and any other relief as is appropriate. He is represented by attorneys Michael A.
