Real estate agent alleges Harris County broker failed to pay overtime

HOUSTON — A Fort Bend Count real estate agent is suing a Harris County real estate broker, alleging failure to pay overtime wages.

Nyok Lee, also known as Steve Lee filed a class action lawsuit, individually and on behalf of all others similarly situated, June 27 in the Houston Division of the Southern District of Texas against www.Urban,Inc. doing business as Urban Living, alleging violation of the Fair Labor Standards Act.

According to the complaint, Lee was regularly required to work seven days each week and for more 40 hours per week as a salesman but was not paid overtime compensation or guaranteed minimum wages. 

The plaintiff alleges a Urban Living misclassified him as an independent contractor, willfully disregarded the provisions of the FLSA and denied to pay him at a rate of one and one-half of his his regular rate for each hour worked in excess of 40 per week.

Lee seeks a trial by jury, unpaid overtime compensation for all hours worked in excess of 40 hours in a single week, attorney fees, legal costs and expenses, prejudgment and post-judgment interest and such other relief to which he is entitled.
