Worker alleges employer failed to pay proper overtime

HOUSTON — A Harris County man is suing a siding business, alleging failure to pay overtime wages.

Paul Winston Perry filed a class action lawsuit, individually and on behalf of other employees similarly situated, Aug. 22 in the Houston Division of the Southern District of Texas against Amazing Siding Corporation, doing business as Renewal by Andersen of Houston, and Robert W. Birner, alleging violation of the Fair Labor Standards Act.

According to the complaint, Perry routinely worked more than 40 hours per week but did not receive overtime compensation for the week that the pay was earned. The plaintiff alleges the defendants failed to pay him at least one and-a-half times his regular rates of pay for all hours worked more than 40 a week but instead carried the extra overtime hours to a subsequent week or until there was a week where he worked less than 40 hours and applied those hours to that week.

Perry seeks a trial by jury, all unpaid overtime wages, liquidated damages, attorney fees, legal costs and expenses and such other relief as allowed by law. He is represented by attorneys Trang Q. Tran and Alecia D. Best of Tran Law Firm LLP in Houston.
